For most people, the sale or purchase of real estate is the largest Contract they will enter into. It is therefore recommended that legal advice be obtained from a professional trained in Contract Law.

At Dwyer Legal, we have experienced conveyancing lawyers and clerks. We can assist with all Victorian property transactions including buying or selling a home, unit, vacant block, strata title, commercial real estate or rural property. We also handle family transfers and transfers to and from Self Managed Superannuation Funds and Family Trusts.

Buying – we will review the documents prior to you signing to ensure you understand your obligations under the Contract. We also make all arrangements for settlement including searching the Title, arranging settlement with your financier, preparing Title Transfer documents, advising on and arranging Stamp Duty concessions (principal place of residence, pensioner, first home owner or family farm), adjusting rates and so forth. Our staff are approachable and available to answer any questions you may have through this process.

Selling – when selling a property, your Estate Agent will ask for the ‘Section 32 Statement’. This document is required to ensure that the Contract with the Purchaser is legally binding.  We will prepare the Section 32 Statement on your behalf and arrange finalisation of the sale up to and including settlement.

What is Conveyancing?

Conveyancing is the process of transferring legal ownership of land from one person or entity to another.

What does Conveyancing include?

On behalf of Purchasers, we check the Contract prior to you signing, make enquiries about the Title and the property. We then prepare all documents required for settlement, liaise with your lender (if applicable), attend to adjustment of rates and attend settlement. Generally, there is no charge by our firm for an initial review of Contract documents and provision of verbal advice, should the matter not proceed.

On behalf of Vendors, we prepare the Section 32 Statement required by the Sale of Land Act, check the Contract prior to you signing, prepare all necessary documents required for settlement, arrange a Discharge of your Mortgage (if applicable) and arrange and attend settlement.

What other Services do we offer?

Our firm can assist with all legal matters. From a property perspective, this includes subdivisions, spouse transfers, leases, stamp duty concessions and family farm transfers. Other services we offer include Wills, Powers of Attorney, Deceased Estates, Family Law and Criminal Law.

Why Choose Us?

As lawyers, we are trained in all aspects of property law but also provide a full legal service. For example, we are qualified to provide the legal advice often required by lenders on signing of the Mortgage documents. Generally, when we are handling the Conveyancing for you, we will provide this advice at no additional charge. We are also available to provide this service to clients that do not use our services for the Conveyancing (for example, a Conveyancing Company that is not qualified to provide legal advice on Mortgage documents), with charges at our standard hourly rates.

We recommend that when purchasing property you review your Will. We will review your existing Will at no charge and also offer a discount on new Wills when we handle the Conveyancing for you.
